What is the Preferred Method to Report an Odor or Noise Nuisance?

The Village has been working with the "See, Click, Fix" CRM platform to manage and track any reported issues concerning odor and noise nuisances. This app can be downloaded on any smartphone and allows for immediate reporting of your exact location where you are detecting an odor or noise. Please accurately track the location of where you are noticing the nuisance,  as this will create the best results for further Village research into this topic. 

History of Prestige Conflict from Inception to the Current State of the Litigation

Due to the volume of questions the Village of Mount Prospect (“Village”) receives related to Prestige Feed Products, LLC’s (“Prestige”) operation of its facility from 431 Lakeview Court, Suite A, Mount Prospect, Illinois (“Facility”), the Village has compiled the following timeline of certain key events. The Village intends to update this timeline as additional key events occur.  The timeline is also available as a PDF document.

Community Airborne Chemical Assessment 

The Village Board approved a contract with RHP Risk Management Inc.  (RHP) on March 4, 2025 to provide both air sampling and emission dispersion modeling related to health impacts of the odor being discharged by Prestige.  On June 23-24, 2025, RHP conducted an airborne chemical assessment in residential areas surrounding Prestige Feed located at 431 Lakeview Court. 11 compounds were included in the air testing study including: 1) Acetaldehyde, 2) Acetone, 3) Acetonitrile, 4) Adipic acid, 5) Butyric acid, 6) Dimethyl disulfide, 7) Dimethylamine, 8) Methanol 9) Pentanol, 10) Phenol, and 11) Propene. The conclusion from the study is that under conditions believe to reasonably reflect the scenario of concern the sampling results for the 11 compounds were found to be below their corresponding health-based criteria ("safe exposure level") and odor threshold.

 Previous Public Meetings 

At the March 4, 2025, Village Board meeting, the Village Board authorized the Village Manager  to retain RHP Risk Management Consulting Health Scientists.  In response to citizen complaints, the Village found and secured a scientifically focused research group that can study the area, understand the specific needs of the Village, and test for any materials hazardous to citizen health. Research into testing organizations led the Village to the RHP organization RHP. RHP scientists use scientifically rigorous regulatory framework in toxicology, exposure modeling, etc., to assess risk profiles of chemicals. RHP will provide both air sampling and emission dispersion modeling from multiple data points to assist the Village in the on-going litigation with Prestige Feed. The cost is a fixed fee of $69,000.

Staff sought Village Board approval at the August 7, 2024, Village Board meeting to continue the engagement with Meltzer, Purtill & Stelle, LLC (MPS)  to provide special council for the Prestige Feed Litigation. Staff contracted with MPS  to add this firm to the Village's legal team for the Prestige Feed Litigation; working with Village Attorneys, Lance Malina and Allen Wall.  MPS has assisted with the enhanced 3rd amended counterclaim for injunctive relief filed on July 19 and MPS will take point in court.  

 Illinois Regulatory Bodies Involvement 

On March 14, 2025, the Office of the Illinois Attorney General filed a lawsuit against Prestige Feed Products.  

The Village of Mount Prospect has reviewed the Illinois Environmental Protection Agency’s (“IEPA”) recent complaint against Prestige. The IEPA claims Prestige’s operation of its Mount Prospect facility violates odor and noise regulations contained in Illinois statue and the Illinois administrative code. The Village of Mount Prospect’s case has similarities to the IEPA’s case but is different. Notably, the Village’s case against Prestige involves claims of violations of the Village Code regulating odors and permitted uses under the zoning code. We will continue to monitor the IEPA’s case against Prestige and, of course, continue to litigate the Village’s current action against Prestige
