Clean Air Regulations
State of Illinois's Smoke Free Illinois Act
Clean Air Regulations Ordinance -

Recently, the Village of Mount Prospect revised their Clean Air Regulations ordinance to comply with the State of Illinois’s Smoke Free Illinois Act. The ordinance continues to prohibit smoking on or in any train station, platform or bus shelter owned or used by any public transportation agency or in any municipal parking garage.

Importantly, the ordinance now regulates smoking shelters, an outdoor structure defined as “any shelter where smoking is permitted by a business owner and is not an ‘enclosed area’ as defined by the Smoke Free Illinois Act.” The construction, installation, and utilization requirements of the shelter are set forth in the revised ordinance.
