The Planning & Zoning Commission review process involves a three-phase procedure: (1) Staff review of the application and related materials; (2) review and recommendation by the Village’s Planning & Zoning Commission; and (3) review and approval by the Village’s Board of Trustees. (Note: There are certain requests that do not require action by the Board of Trustees). The process generally can be expected to take from twelve to sixteen (12 – 16) weeks from the time of initial application through final action by the Village’s Board of Trustees. The Planning & Zoning Commission review process is outlined below:

Pre-application Meeting -Although this first step is optional, it is highly recommended that the Applicant schedule a meeting with the Village’s Planning Division and other appropriate Staff. This meeting would be used to discuss the feasibility of the proposal and obtain a level of familiarity with Village requirements and procedures.

Submittal of Petition - This step involves the Applicant’s submittal of the application and related documents, including, but not limited to, the following: a complete original application; fifteen (15) copies of the required documents; the required application fee; and other related materials depending on the type of request. For more detailed information regarding the submittal requirements please refer to the specific handouts for each type of application request.

Staff Review - Upon receipt of the application, the proposal will be reviewed by the Community Development Department and transmitted to other Village Departments. Upon completion of review, Staff will submit its comments to the Applicant. Upon receipt of the comments, the Applicant shall make the necessary changes or revisions, and/or submit any additional materials requested. When all required revised plans and other documentation have been submitted and found acceptable, a Planning & Zoning Commission meeting date will be assigned. The Planning Division will submit a written report explaining the Applicant’s request and related staff comments, including comments from other Village Departments. A copy of the report will be forwarded to the Applicant approximately five (5) days prior to the Planning & Zoning Commission meeting.

Planning & Zoning Commission Action - At a regularly scheduled meeting (typically the 4th Thursday of each month), the Planning & Zoning Commission (P&Z) will conduct a public hearing to review the request. All persons desiring to express an opinion regarding the petition will be given an opportunity to be heard at the meeting. The P&Z has final administrative authority for all fence variations and variation requests that do not exceed twenty-five (25%) of a requirement stipulated by the Village’s Zoning Ordinance. After concluding its review, the P&Z, upon the majority vote of its entire membership, will approve or deny the request. For requests that require review and action by the Village’s Board of Trustees, the P&Z will submit a recommendation to the Board of Trustees for their consideration. All actions taken by the P&Z can be appealed to the Village’s Board of Trustees by submitting a letter to the Director of Community Development within five (5) calendar days of the P&Z’s final decision.

Village Board of Trustees Action - Upon receipt of the P&Z recommendation, the Village’s Board of Trustees may grant, deny or modify the petition as it demes appropriate (by majority vote). If the P&Z does not recommend approval of the Applicant’s request, a positive vote by at least 5 Trustees (if all 7 are present) or 4 Trustees (when less than 7 are present) would be required for approval.
Please Note – The recommendations and technical assistance provided by Village staff during the course of the review process is advisory in nature. The authority to approve or deny a petition lies solely with either the Planning & Zoning Commission or the Village’s Board of Trustees, depending on the nature of the request.
